Terms & Conditions
Effective: October 19, 2026
1. The Service
Icarus ("the Platform", "we", "us") is an AI creative suite that makes photos, videos and ads, operated by Plaitr Technology LLC. You upload reference photos, describe what you want in plain words, and Icarus generates campaign images and videos, keeps a model's face and your product consistent across shots, and lets you use it from the AI apps you connect. By accessing or using the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Platform.
2. Accounts & Eligibility
- You must be at least 18 years old to use Icarus.
- Accounts are created and secured through Google Firebase Authentication. You are responsible for keeping your sign-in credentials safe and for all activity under your account.
- A workspace is created for your account. You may invite team members to collaborate within your workspace, and you are responsible for their use of it.
- You must provide accurate information and keep it up to date.
3. Acceptable Use
Icarus generates images and videos of real people and products, so these rules matter. You agree not to:
- Upload a photo of a real person, or generate their likeness, without that person's consent.
- Create intimate, sexual, or nude imagery of a real person without their consent, or any sexual content involving minors. This is strictly prohibited.
- Create deceptive deepfakes of real people, or content designed to impersonate someone or make a fabricated image appear authentic in a misleading way.
- Generate content that is illegal, harassing, hateful, defamatory, or that promotes violence or self-harm.
- Infringe anyone's intellectual property, publicity, or privacy rights, including uploading products, logos, or images you do not have the rights to use.
- Use a real person's name, face, or voice, including a famous person's, to suggest they endorse you, your product, or Icarus, or use their likeness in an ad without their written permission.
- Resell, sublicense, or provide third-party access to the Platform's generation capabilities or API without our written permission.
- Reverse-engineer, decompile, or extract the Platform's source code, or use automated tools to overload the Platform or bypass rate limits.
The full rules are in our Acceptable Use Policy, which is part of these Terms. We may remove content and suspend accounts that break them. To report content that uses your work, your likeness, or an intimate image of you without consent, see Takedown requests.
4. Your Content & Ownership
- You own your outputs. As between you and us, you own the images and videos you generate through your account, and you may use them for any lawful commercial or personal purpose. There are no hidden licensing fees.
- Your uploads stay yours. You keep ownership of everything you upload. By uploading, you confirm you have the rights and any necessary consents (including for real people's faces and for products, logos, and brand assets), and you grant us a limited license to store and process that content, and to send it to our AI providers, solely to provide the service to you.
- Our platform is ours. Icarus, including its design, code, and features, belongs to Plaitr Technology LLC and is protected by intellectual property laws. These Terms grant you no rights in it beyond using the service.
5. Shared Content
You can share a video you made to the Icarus Library, so other people can see it and make their own version.
- It is public. A shared video can be seen by everyone who uses Icarus and by anyone on our public Library pages. So can the photos it was made from, its prompt, and your workspace name.
- You confirm you have the rights. When you share, you confirm that you made the video or have permission to share it, and that everyone shown in it has agreed to it being shared.
- The licence you give us. While a video is shared, you give Icarus a free, worldwide licence to show it, to let other people recreate it with their own photos, and to use it to promote Icarus.
- You can unshare any time. Unsharing takes the video out of the Library. Videos other people already made from it stay theirs.
- We can remove it. We can take down anything shared to the Library, for any reason, and we can turn off sharing for a workspace. A video we take down cannot be shared again.
- Reports and takedown notices. To report something in the Library, or to send a takedown notice, email [email protected] with the link to the video and why it should come down. You can also use Report on the video itself.
6. AI-Generated Output
Icarus uses AI models to generate content. AI output can be inaccurate, unexpected, or resemble existing works or people, and similar prompts may produce similar results for other users. You are responsible for reviewing what you generate before you use it, and for making sure your use is lawful and does not infringe anyone else's rights. We do not use your uploads or generated content to train foundation models (see the Privacy Policy for details).
Everything Icarus makes is made with AI. If you publish something that looks like a real person, place, or event and could mislead people, you are responsible for saying it was made with AI where the law requires it.
7. Other Brands
Icarus names the AI models it runs and shows their makers' names and logos, such as Google, OpenAI, ByteDance, and Kling. These names and logos belong to their owners. We show them only so you know which model makes your shot. Those companies do not sponsor or endorse Icarus, and Icarus is not affiliated with them.
8. Takedowns & Repeat Infringers
We respond to copyright notices under the US Digital Millennium Copyright Act, and to requests to remove someone's likeness, private information, or intimate images. How to send one is on our Takedown requests page. We close the accounts of people who repeatedly infringe other people's rights.
9. Claims About Your Content
If someone makes a claim against Plaitr Technology LLC because of what you uploaded, made, or shared with Icarus, or how you used it, including a claim that you used their work, face, name, voice, or brand without permission, you agree to cover the costs of that claim, including reasonable legal fees and any amount we have to pay. We will tell you about the claim and let you help defend it.
10. Money, Billing & Refunds
This section describes what you are buying. Read it before you pay.
- One balance. Your workspace holds a single balance in US dollars. A paid plan adds to it each billing period, and you can add more credits at any time. Plan credits and added credits go to the same balance.
- What a render costs. The price of each image, edit, upscale or video is what the AI provider charges us to make it, plus our margin. Current prices are shown in the app and on our pricing page.
- You are charged when the work starts, not later. Your balance is reduced the moment a job is queued, because that is the moment we start paying an outside AI provider to make it on your behalf. That provider charges us whether or not you like the result. This is a service that is delivered immediately and consumed as it is delivered.
- Texting Icarus. Each reply Icarus sends by text costs what the AI provider charges us for it, plus our margin if any, taken off your balance right after the reply. Because the reply is already made, this can take your balance below zero. Your next top-up settles it, and Icarus does not answer new texts while the balance is below zero.
- Failed renders cost nothing. If a render fails, the amount is returned to your balance automatically. You do not need to ask.
- Subscriptions. Paid plans are billed through our payment processor, Stripe, on a recurring monthly or annual cycle and renew automatically until you cancel. You can cancel at any time from Billing in the app. Cancelling stops future renewals and takes effect at the end of the period you have already paid for. Enterprise and custom plans may be offered under separate written terms.
- Refunds. Money already spent on work we delivered is not refundable, because the work was made on request and the provider cost is real and not recoverable by us. If you think something has gone wrong with a charge, email us at [email protected]. We would rather fix a mistake than argue about one.
- No transfers, no cash out. A balance cannot be moved between workspaces or exchanged for cash.
- Price changes. We may change prices with reasonable notice. A change applies to work made after that notice, never to work you have already paid for.
11. Chargebacks
A chargeback is when you ask your bank to reverse a payment instead of asking us. Email [email protected] first. It is faster, and we can fix things your bank cannot.
If you open a chargeback and your bank decides in your favour on a payment for work that was delivered:
- The credits that payment added are taken back off your balance, including any you have already spent. Your balance can go negative as a result.
- Your workspace is suspended and cannot generate anything until the balance is settled.
- We respond to your bank with the record of your account: when you agreed to these Terms, from which address and browser, what you paid, and what was generated and delivered to you.
We keep these records for exactly this purpose. If a dispute was a mistake and you want your workspace back, email us and we will sort it out.
12. Connected Apps
You can connect third-party apps (such as Gmail, Google Drive, Notion, or Slack) so Icarus can act on your behalf. You authorize us to access those apps only to perform the actions you request, and your use of each connected app remains subject to that provider's own terms. You can disconnect an app at any time.
13. Termination
You may stop using Icarus and delete your account at any time. We may suspend or terminate access if you breach these Terms, misuse the Platform, or where required by law. On termination, your right to use the Platform ends; we handle your data as described in the Privacy Policy.
14. Disclaimers
The Platform is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Platform will be uninterrupted or error-free, or that AI output will meet your expectations or be fit for a particular purpose.
15. Limitation of Liability
To the maximum extent permitted by law, Plaitr Technology LLC and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Platform. Our total liability for any claims arising from your use of the Platform shall not exceed the amount you paid to us in the twelve months preceding the claim.
16. Changes to These Terms
We may modify these Terms from time to time. Material changes will be communicated by email or a notice on the Platform. Your continued use after changes take effect constitutes acceptance of the revised Terms.
17. Governing Law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules, and any disputes will be resolved in the state or federal courts located in Wyoming.
